VICTIMS’ AID, VICTIMS, NEVER ALONE AGAIN

A system of help and assistance allowing any victim, especially of a criminal offence, to benefit from a more thorough consideration of his or her interests as close as reasonably possible to the facts.

WHICH VICTIMS ?

Victims of crimes

In the penal sense of the term, a victim is any person who has suffered from an offence, a direct attack on his physical, sexual or psychological integrity, or on his property (domestic violence, threats, insults, rape, breach of trust, theft, damage…).

The victims’ aid service provides free assistance to people who have suffered the consequences of an act condemned by the law: this is called a criminal offence.

The scope of the service also extends to victims of accidents and disasters.

WHO CAN USE THE SERVICE ?

  • A WELCOME TO ANY PERSON WHO
    BELIEVES HE OR SHE IS A VICTIM OF A CRIME
  • Whether they are directly affected by it,
  • or a relative,
  • his/her spouse,
  • his/her child,
  • or a direct witness to an offence
  • ANY PERSON WHO IS A VICTIM OF COLLECTIVE EVENTS (accidents, natural or industrial disasters, attacks)
  • ANY PERSON IN DISTRESS

ADAVIM FRANCE VICTIMES MARTINIQUE is a court auxiliary specialized in victims’ aid. It intervenes mainly at the Fort-de-France Judicial Court and manages the Bureau d’aide aux victimes (BAV) due to its generalist scope. It intervenes in all places that receive or work with victims (Homes and in the Justice and Law Offices, points of access to the law, Maisons France Services, gendarmerie and police services, hospitals, town halls, etc.).

The victim support services receive victims in confidence, with or without an appointment, in order to help them take stock of the situation free of charge, to inform them and to accompany them in the possible steps to be taken.

HOW DO I GET COMPENSATION ?

COMPENSATION BY THE OFFENDER

If a person is a victim of a criminal offense, and if the perpetrator is summoned before a criminal court, he or she may file a civil suit and benefit under certain conditions to one of the following provisions :

COMPENSATION FROM THE GUARANTEE FUND

Victims of a crime, act of terrorism, traffic accident or other damage may receive compensation under certain conditions.

 INSURANCE COMPENSATION

Depending on the offense that caused the injury, the victim’s insurance policies may possibly allow for compensation.

 COMPENSATION BY THE COMMISSION D’INDEMNISATION DES VICTIMES D’INFRACTIONS (CIVI)

If the victim’s loss cannot be compensated by the perpetrator or by other organizations, he or she may refer the matter to the Commission d’indemnisation des victimes d’infraction (CIVI), which is based in the judicial court.

COMPENSATION THROUGH THE “SARVI” RECOVERY ASSISTANCE SERVICE

“SARVI”, Service d’Aide au Recouvrement des Victimes, is a service from the Guarantee Fund that can help a victim recover damages awarded by the court following a criminal trial.
This assistance is available to individuals (not legal entities – companies, associations, etc.)
